Environmental Claims and Toxic Torts
The Firm's experience includes environmental clean up, operations and remediation, as well as the defense of complex personal injury or wrongful death claims alleging toxic exposure and/or environmental contamination. Environmental clean up and remediation claims include experience with oil spill clean up under the Clean Water Act as amended by the Oil Protection Act and other environmental hazards affecting the Gulf of Mexico and its coast, as well as rivers, ports and other environmentally sensitive waterways and habitats. We have experience reporting to and working with the Coast Guard and other interested agencies, including the identification and appointment of oil spill cleanup operators, the selection and monitoring of wreck removal contractors, and defense of environmental claims involving vessel operators. The Firm's lawyers have assisted with mitigation of penalties that arise from oil spills. The Firm has also successfully obtained recovery for land-based and marine interests for business interruption and economic loss resulting from a spill. Our other experience includes the defense of both individual and mass tort cases alleging asbestos exposure, work-related exposures to other harmful chemicals, claims asserting damages from toxic inhalation, and cases involving exposure to allegedly harmful products.
